Maryland legalized Adult-Use!
What happens now?
This is an exciting time for cannabis in Maryland, we wanted to update everyone on what this framework looks like for our patients. Starting July 1, 2023, adults 21 or older can purchase cannabis in a licensed dispensary; with a government-issued photo ID.
What forms of ID are acceptable?
Valid ID must be government-issued and includes a driver’s license, state ID card, passport/passport card, military ID, and tribal card.
What is the personal use amount?
Adults 21 years and older; will be able to possess up to 1.5 ounces of cannabis flower, up to 12 grams of concentrated cannabis, or a total amount of cannabis products that do not exceed 750 mg of THC. This is known as the “personal use amount.” A qualifying patient may possess up to 120 grams of useable cannabis and 36 grams of Delta- 9- Tetrahydrocannabinol (THC) in the case of a cannabis-infused product.
Will I have to pay tax on Medical Cannabis?
A sale of cannabis or cannabis products to a qualifying patient is not subject to taxes imposed on the sale of cannabis or cannabis products. Adult-use cannabis products are subject to a 9% sales tax.
Will I be able to grow my own?
Adults will be allowed to grow up to two cannabis plants. The plants must be out of public view and secure. However, a qualifying patient at least 21 years or older may not cultivate more than four cannabis plants.
Will Maryland have reciprocity for medical cannabis patients from other states?
Only individuals who are registered, certified Maryland medical cannabis patients and caregivers can purchase products under the parameters of Maryland’s Medical Cannabis Program. However, individuals from out-of-state who are at least 21 years of age with government-issued ID will be permitted to purchase adult-use cannabis from licensed dispensaries in Maryland beginning on July 1, 2023. Interstate transport of cannabis is still prohibited under federal law.
